These terms govern your use of huntercanningphoto.com and any photography engagement with Hunter Canning Photography. The site and the services provided through it are operated by The Royal We, LLC, a New York limited liability company. By using the site or engaging us, you agree to these terms.
1. About us and our services
The Royal We, LLC (operating as Hunter Canning Photography, "we," "us," or "Company") is a New York-based photography practice covering Off-Broadway and college theater production stills, cabaret, gala and event coverage, corporate headshots, and editorial portraits. Inquiries submitted through the site or by email become engagements only after a separate written agreement (statement of work, photo retainer, or contract) is signed by both parties. These terms apply to your use of the site at all times and to photography engagements unless an executed agreement says otherwise.
2. Photographs and intellectual property
Hunter Lee Canning is the author of every photograph on this site, retains copyright in all photographs delivered under any engagement, and licenses usage to clients on the terms set out in the engagement agreement. Photographs may not be cropped, recolored, composited, AI-modified, or otherwise materially altered without the photographer's written consent. Photographer credit ("Photo by Hunter Lee Canning") must accompany editorial use unless explicitly waived in writing. The site itself, the wordmark, and the underlying source code are also the intellectual property of The Royal We, LLC or its licensors.
3. Portfolio and self-promotional use
Unless your engagement agreement says otherwise, the photographer reserves the right to display delivered work in this site's portfolio, in printed portfolios shown to prospective clients, and in award and competition submissions. Photographs of identifiable individuals are displayed publicly only with appropriate consent. To request removal of a specific photograph from the public portfolio, email legal@huntercanningphoto.com.
4. Acceptable use of this site
You agree not to: use the site for any unlawful purpose; harvest email addresses or other contact information; submit false inquiries or impersonate another person; download photographs for use beyond personal viewing without a license; train machine-learning models on any content from the site; interfere with site security or availability; or reverse-engineer the site's underlying systems. We may suspend or terminate access to the site for any user who violates these rules.
5. Inquiries and engagements
Submitting an inquiry through the site or to any contact address listed on it does not create a contract. We will respond to inquiries we are able to act on and will provide a quote, scope, and engagement agreement before any work begins. Fees, deliverables, retainers, deposits, deliverable formats, turnaround, license grants, and cancellation policies are governed by the executed engagement agreement, not by this page.
6. Third-party links
The site links to third-party properties operated by us (huntercanning.com, plumwheel.com, ragnos.io) and by others (press outlets, social platforms). We do not control and are not responsible for the content or practices of third-party sites.
7. Disclaimers
The site and its content are provided "as is" without warranty of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We make no representation that the site will be available without interruption or free of errors.
8. Limitation of liability
To the maximum extent permitted by law, The Royal We, LLC and its officers, members, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, arising out of or related to your use of the site, even if advised of the possibility. Our total liability arising out of or related to the site is limited to one hundred United States dollars (USD $100). Liability arising out of a contracted photography engagement is governed exclusively by that engagement agreement.
9. Indemnification
You agree to defend, indemnify, and hold harmless The Royal We, LLC and its officers, members, employees, and agents from any claim or demand made by a third party arising out of your breach of these terms or your misuse of the site.
10. Governing law and jurisdiction
These terms are governed by the laws of the State of New York, without regard to conflict-of-laws principles. You agree that any dispute arising out of or related to these terms or the site will be brought exclusively in the state or federal courts located in New York County, New York, and you consent to the personal jurisdiction of those courts.
11. Dispute resolution
Before filing any claim, the parties will attempt informal resolution by good-faith negotiation for at least thirty days after written notice of the dispute is delivered. If the parties cannot resolve the dispute informally, any claim not exempted below will be resolved by binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules, before a single arbitrator, in New York County, New York. Each party waives the right to participate in any class, collective, or representative proceeding. Claims for injunctive relief, intellectual property enforcement, and small-claims-court matters are exempt from arbitration.
12. Changes to these terms
We may update these terms from time to time. The "Last updated" date at the top of this page reflects the most recent revision. Material changes will be announced on the site. Continued use of the site after a change indicates acceptance of the revised terms.
